Do you need a permit for a porta potty in Detroit?

A porta potty on private property in Detroit, such as a driveway, yard or private lot, does not usually need a city permit. A porta potty placed in the public right-of-way, meaning a street, alley, sidewalk or the grass strip by the curb, falls under Detroit Public Works right-of-way permits. Public special events need City of Detroit approval.

The City Engineering Division of Detroit Public Works issues right-of-way permits, including permits for occupying the right-of-way. The office is at 2 Woodward Ave, Suite 642, and the phone number is (313) 224-3935. Portable toilets are not named on the city’s permit page, so ask the office which permit fits before you place a unit on a sidewalk or street.

Our rule of thumb: If any part of the unit would sit past your property line, call us first. We almost always find a spot on the driveway, side yard or a neighbor-approved lot that avoids the permit.

How many restrooms does a Detroit special event need?

A Detroit special event needs at least 1 portable restroom per 100 attendees and 1 handwashing station for every 4 to 5 portable restrooms, according to the City of Detroit Special Events Applicant Guide. A 1,000-person street festival needs at least 10 portable restrooms and 2 handwashing stations.

  • The special-event application is due at least 60 days before the event.
  • Organizers submit a port-a-john contractor agreement, reviewed by the Detroit Health Department.
  • The site map must show where the restrooms and handwashing sinks go.
  • Gray water may not be poured into storm drains. Wastewater containers come from the restroom company.
  • At least 5% of the units in each cluster should be wheelchair accessible (2010 ADA Standards §213.2).

What are Michigan’s porta potty rules for construction sites?

Michigan construction sites must provide 1 toilet for 1–20 workers, 2 toilets for 21–40 workers, and 1 more toilet for each additional 40 workers or fewer, under Michigan Administrative Code R 408.40129. Where there is no sanitary sewer, chemical toilets such as porta potties are allowed, and they must be serviced regularly and stocked with toilet paper.

The federal OSHA rule, 29 CFR 1926.51(c), uses a different table: 1 toilet for 20 or fewer workers, 1 toilet and 1 urinal per 40 workers for 20 to 199, and 1 toilet and 1 urinal per 50 workers for 200 or more. Michigan contractors follow the state plan. Read the full Michigan construction toilet guide.

Who is allowed to pump and haul porta potty waste in Michigan?

In Michigan, waste from portable toilets is septage waste. Companies that pump and haul it need a septage waste business license from the Michigan Department of Environment, Great Lakes, and Energy (EGLE), and each pump truck must be licensed and inspected. Waste must go to an approved receiving facility.

Ask any porta potty company where its waste goes. A legitimate hauler can name the facility. We never dump gray water or waste on site or into storm drains.

Permit questions

Do I need a permit to put a porta potty in my driveway in Detroit?

No permit is usually needed for a porta potty on your own driveway or yard in Detroit. Landlords, HOAs and condo boards can set their own rules, so check those first.

Can a porta potty go on the street in front of my house?

Only with approval. A unit on a Detroit street, sidewalk or alley occupies the public right-of-way, which falls under Detroit Public Works permits. We try to place the unit on private ground instead.

Who signs the port-a-john contractor agreement for a Detroit event?

The restroom company signs it with the event organizer. We fill in unit counts, handwashing, service times and waste removal, and return it for your special-event application.

How far ahead do I apply for a Detroit special event?

The City of Detroit asks for the special-event application at least 60 days before the event. Late applications may be denied, so book restrooms early enough to include them.

Do suburbs have the same rules as Detroit?

No. Each city and township sets its own street-use and event rules. Your city clerk or building department can tell you what applies; each of our service area pages names the office to call.
